This 5,233-acre tract of land is known as Burtch Tract. The Haudenosaunee Six Nations filed a claim on the land in 1989[1, 2], arguing that this land was never surrendered, and that there are no existing documents proving otherwise. Instead, there are a number of documents suggesting that this land was specifically reserved for the Haudenosaunee future generations, along with the Johnson's Settlement, the Oxbow Bend, Martin's Tract and Eagle's Nest, all of which were to be leased out on short term leases only. Despite the will of the Haudenosaunee that this land be reserved for their future generations, and be let out only on short-term leases, the Burtch Tract lands were included in the boundary of Brantford Township in 1846 and allegedly taken out of the Haudenosaunee Six Nations' hands.
During the 2006 Haudenosaunee protest of a development in Caledonia, Ontario,[1] part of these Burtch Tract lands were promised returned to the Haudenosaunee Six Nations Confederacy Council in negotiations between the Confederacy Council, the Province of Ontario, and the Canadian government. However, to this date these lands have not been returned to the Haudenosaunee Six Nations, and no movement has been made by Canada towards settling this land claim.
